Journey’s ongoing legal battle between Neal Schon and Jonathan Cain is intensifying.
Cain has recently submitted new documents alleging that Schon has failed to adhere to a mediated agreement intended to settle their financial disputes. Schon had previously stated his consent to Cain’s request for a third-party mediator to oversee their touring business, Freedom 2020. However, Cain now asserts that Schon is attempting to restrict the mediator’s role.
“It became apparent that Mr. Schon is attempting to backtrack on his agreement for the Court to appoint a custodian to serve as a third, deadlock breaking director of Freedom 2020, Inc., and is now seeking to inappropriately limit the role of the custodian. This is inconsistent with Respondent’s counsel’s prior communications with the Court and Discovery Facilitator Joseph Slights explicitly agreeing to the appointment of a third, deadlock breaking director,” the case file states.
Cain’s attorney, Kasey H. DeSantis, argues that Schon’s actions are contrary to their previous court agreements. Cain had previously sued Schon, alleging overspending and financial issues on their tour with Def Leppard and Steve Miller, claiming that Schon was squandering up to $10,000 a night. The case was expedited, and Joseph Slights was appointed as a mediator on August 7.
Despite Schon’s accusations of Cain creating a ‘toxic work environment,’ a tentative agreement was reached on August 22. Cain is now seeking judicial approval for the original deal.
